Unfortunately over half of all marriages in the Los Angeles area end in divorce. We specialize in making this difficult transition in client’s lives as smooth as possible.
If you had a child with a partner and not married, we will ensure that your parental rights are preserved, that paternity is established, that proper custody and visitation orders are in place and also address any child support issues.
Spousal Support is one of the most fought over issues in most dissolution of marriage cases and we will conduct all necessary discovery in order to ensure that an appropriate amount of spousal support is set. On the other hand, if spousal support is not appropriate given the parties’ incomes and assets, or if the supported spouse refuses to become self-supporting after a reasonable period of time, we will fight to reduce or eliminate support all together.
It is too often when one of the parents refuses to support their children at the level required by the State of California or when one of the parents attempts to take advantage of the situation by asking for much more than they are entitled to under the law. Our expertise is to ensure that the correct order is put in place.
We strive to achieve the best results for you and your children in any situation, minimizing the impact of the dispute on the minors while protecting the parent’s rights. We will establish a visitation schedule that is most suitable for your case, either through negotiation, mediation or litigation.
There is a great misconception that Domestic Violence must include physical violence. In fact, Domestic Violence includes any kind of acts that amount to emotional abuse, disturbing the peace, threats of violence, stalking, overly controlling and other similar behaviors. If you believe that you have been a victim of domestic violence, we will quickly assess the situation and obtain a restraining order the next business day after the initial consultation.
Judges are people too and they make mistakes. If you feel like a Judge has made a mistake in your case, we will review the court transcripts and all the relevant paperwork and provide you with an evaluation of whether or not the issue is appealable. We will file an appeal or a Writ where appropriate to make sure that any mistake is corrected.
There are very limited situations in which an annulment of the marriage can be obtained. We are experts on all of them and if you feel like your partner entered the marriage under false pretenses, such as to obtain a Green Card, or is incapacitated in some way, we will evaluate your situation and obtain an annulment if the law permits given the circumstances.
If one of the parents is very wealthy, then the California Guideline does not apply to child support calculation. We have extensive experience with such cases and have the unique expertise required, not possessed by most Family Law practitioners, to ensure that the correct child support is put in place, commensurate with the children’s needs under the circumstances.
The entry of Judgment in a Family Law case does not necessarily mean that the case is over. If there has been a change of circumstances with respect to child custody, child support or spousal support, we will file a Motion with the Court to modify those orders to suit the new circumstances. If your former partner refuses to comply with any of the orders in the Judgment, we will come up with the best strategy to force compliance. If something was omitted from your Judgment that should have been in there, such as a forgotten asset or a debt, a retirement plan or anything else, we will make sure that those are properly addressed and included.
Do not attend an interview with a social worker without an attorney if you are being investigated for any kind of alleged child abuse. If you are being investigated by the Department of Child and Family Services in connection with some kind of child abuse allegations, we will prepare you for the interview with the social worker and attend with you to ensure that your rights are fully protected and the interview goes smoothly. If a Dependency Case has been filed against you, we will guide you along the way and work to get the case resolved as soon as possible.
